Illinois Leaks | Cook County Sheriff Candidate Removed From Ballot; Not Qualified To Hold The Office –

Cook County, IL. (ECWd) –

Carmen Navarro Gercone, Democrat Candidate for Sheriff of Cook County was removed from the ballot by the First Appellate District Court after objectors appealed the circuit court’s decision to overturn the Cook County Electoral Board’s decision to remove her from the ballot.

This objection stems from newly passed legislation setting new qualification requirements for candidates for county sheriffs.

The appellate court found that Gercone did not complete the “Minimum Standards Basic Law Enforcement Officers Training Course” as required under the new legislation, never received a certificate attesting to her successful completion of the course and did not complete a substantially similar training program “of another state or the federal government.”

All of her past experience and her multitude of training courses completed, including training courses from the federal government were not sufficient to qualify as substantially similar to the required course.

The Illinois Law Enforcement Training and Standards Board (“ILETSB”) refused to issue her a certification of completing a substantially similar training program, and they are the entity which is responsible for implementation of course requirements. If her training was substantially similar, the ILETSB would have issued her a certificate – they did not.

As a result, the appellate court determined that Gercone was not qualified for the office, that the circuit court errored when it found she was qualified, and that the Cook County Electoral Board was correct when it found she was not qualified and order her name NOT to appear on the ballot.

We do not know at this time if this opinion will be appealed to the Illinois Supreme Court.
